It's still up in the air when Jussie Smollett's character will return to Empire. While Smollett's contract has been extended through season six, reports say there are no plans for his character, Jamal Lyon, to return to the show at this time.

A spokesperson for Smollett says, "We've been told that Jussie will not be on Empire in the beginning of the season, but he appreciates they have extended his contract to keep Jamal's future open. Most importantly, he is grateful to Fox and Empire leadership, cast, crew and fans for their unwavering support."

The actor and musician was charged with 16 felony counts of disorderly conduct alleging he staged a racist and anti-gay attack on himself in Chicago. The charges were later dropped.

Smollett maintains his innocence and is currently being sued by the city of Chicago for all the overtime hours that were spent investigating the alleged attack. Reports say Smollett has moved out of the city.
